Chief Michael Reiter terminated the employment of Off. Molly Olson effective on June 20, 2007 after a Professional Standards investigation determined that Off. Olson's actions on December 25, 2006 were in violation of the policies and procedures of the Palm Beach Police Department.
It was determined that Off. Olson’s actions on December 25, 2006 were in violation of certain policies and procedures of the Palm Beach Police Department as follows:
Count 1 G.O. IV-4, III, 3; Accident, motor vehicle (failure to report, leaving the scene)- Police department personnel shall immediately report motor vehicle accidents in which they are involved with a police department vehicle in accordance with policies and procedures.
Count 2 G.O. IV-4, III, 32; Duties (Procedures), inattention to- Police department personnel shall adhere to standard operating procedures, policies, and directives, and shall faithfully execute all the duties and responsibilities of their assigned position.
Subsection: S.O.P. III-9; Mobile Audio/Video Systems- At the start of each shift or as part of the checking of any newly assigned vehicle, officers will ensure that the system is working by recording onto the hard drive The officer will activate the recorder by turning on the blue lights. The officer will then speak into the microphone, stating the officer's name, I.D. number, zone assignment and vehicle number. The recording will be stopped, rewound and the officer will playback the recording to make sure that it captured the information. If the equipment is operating correctly, the officer may go into service. If the equipment fails to operate correctly, the officer will immediately notify their supervisor and document the problem on a vehicle maintenance report. Each officer will be held responsible for any damage to the equipment caused by misuse and for documenting any problems with the system.
Count 3 G.O. IV-4, III, 50; Evidence/Property, handling, processing, submission- Money or other property coming into the possession of police department personnel which does not belong to such personnel shall be delivered to the proper custodian, and a report shall be made of the transaction. Property and evidence which has been received in connection with official police department duties will be processed in accordance with established procedures. Police department personnel shall not convert to their own use, manufacture, conceal, falsify, destroy, remove, tamper with, or withhold any property or evidence held in connection with an investigation or other official action except in accordance with established procedures.
Count 4 G.O. IV-4, III, 107; Untruthfulness- Police department personnel shall not knowingly make false or untrue statements except as authorized in the performance of duties and as necessary for maintaining covert operations during investigation of criminal activities.
Count 5 G.O. IV-4, III, 29; Drugs, (prescription) while on duty- Police department personnel shall ascertain the likely effect of prescribed drugs from the prescribing physician before reporting for duty. Police department personnel shall obtain the approval of their commanding officer before reporting for duty while taking lawfully prescribed medications likely to impair normal physical and mental faculties.
In accordance with Police Department General order II-19 and Chapter 8 of the Town of Palm Beach’s Personnel Manual, Officer Olson has the right to appeal her termination within fourteen (14) working days.
